Terms and conditions of the Arkkikaluste online store for consumer customers

Näitä Arkkikauppa Oy:n verkkokaupan (”Verkkokauppa”) kuluttaja-asiakkaiden sopimusehtoja (“ehdot”) sovelletaan verkkosivuston arkkikaluste.com välityksellä ostettavien tuotteiden kauppaan Arkkikaluste Oy (”Arkkikaluste”) ja kuluttaja-asiakkaan (jäljempänä ”Asiakas”) välillä.

- Online shopping
Our online store is open to all adults with a working e-mail address. Any company or other legal person can also do business in the online store, but the customer does not have the same rights as a consumer customer under consumer protection law, such as the right to hold the service provider liable for defect in products.
Placing an order in the Online Store does not require registration. The customer must give the information marked as mandatory with each order. The customer must provide the correct information when shopping in the online store. The customer is responsible for the accuracy of the information provided and is obliged to notify Arkkikaluste of any changes in the information without delay.
The customer can buy products for themselves and also as a gift for another person by providing the recipient’s contact information as the delivery address. With regard to gift purchases, Arkkikaluste’s contract partner remains the Customer, meaning the Customer is responsible for checking the order confirmation and delivery, making complaints and paying for purchases.
- Product range and product ordering
Our online store includes finished products and custom-made products. All products in the Online Store are delivered to Customers from Arkkikaluste Oy’s warehouse, meaning Arkkikaluste Oy is the seller and supplier for all products.
Product information, features, availability, price, delivery methods and delivery costs will be notified when selecting and purchasing the product.
To order the product, select the product from the selection in the Online Store. The products selected by the Customer are added to the Customer’s shopping cart, where the desired order quantities for the products are selected. You can also remove products from the shopping cart before confirming the order and paying. The Customer’s order is created when the Customer confirms their order in the online store (check also the section “Right of withdrawal” below). The customer is advised to check the contents of their order carefully before confirming the order. The customer understands and accepts that there is an obligation to pay for the order. Arkkikaluste sends the order confirmation to the Customer to the e-mail address provided by the Customer. It is the Customer’s responsibility to check that the content of the order confirmation corresponds to the Customer’s order and to contact Arkkikaluste’s customer service without delay if they find an error in the order confirmation. The order is binding on Arkkikaluste when Arkkikaluste has provided the Customer with the order confirmation. Arkkikaluste has the right not to accept the order.
- Prices
The prices of the products are valid until further notice or for a specified period. Products will be charged based on the price at the time of ordering. Prices are in Euros and include value added tax.
Product prices include handling and delivery costs.
If an incorrect, too low price is entered for our product in our Online Store in such a way that the Customer should have understood the error in question, a valid contract will not be created from the order.
- Payment method
The customer pays for the product in the online store when ordering. Payment can be made in the Online Store as the online payment currently available and with the most common credit cards.
The payment service for our online store is provided by Klarna. The customer’s bank statement shows Arkkikaluste Oy as the payment receiver. Arkkikaluste does not have access to the Customer’s card information and the payment card information is not stored in Arkkikaluste’s systems.
- Confirmation of the contract
After Arkkikaluste has confirmed and accepted the order, Arkkikaluste will send a confirmation of the agreement to the e-mail address provided by the Customer. The confirmation contains the key information of the order.
- Delivery of products
Arkkikaluste delivers products mainly to Europe, please contact us by e-mail if you want to order from outside Europe. The ordered products will be delivered to the Post office for collection and larger/heavier products will be delivered via a transport company to the delivery address provided by the customer. The home delivery service only applies to addresses in mainland Finland to which there is a solid road connection.
If the order includes products with a different delivery time, Arkkikaluste also has the right to deliver the products to the Customer separately.
The delivery time of the products depends on the availability of the product and the destination of the delivery. Arkkikaluste strives to deliver the ordered finished products as soon as possible within 3–5 weeks of concluding the contract or at a time agreed separately with the Customer.
If the Customer does not pick up the delivered product from the place of delivery within the time limit, as a result of which the product will be returned to Arkkikaluste, and does not explicitly notify about the cancellation of the product within 14 days of receiving the delivery notice, the Customer is deemed to have canceled the order. In this case, Arkkikaluste is entitled to charge the Customer for the costs of processing and delivering the order. Arkkikaluste is entitled to offset the costs mentioned above from the payments received from the Customer to be reimbursed to the Customer before returning the payments to the Customer.
- Delivery delay
If, after receiving the order, it turns out that the ordered product is temporarily or permanently out of stock or there are delivery difficulties in the delivery of the product, Arkkikaluste will notify the Customer using the contact information provided by the Customer.
Arkkikaluste is not responsible for the delay if the delivery is delayed or the order cannot be delivered at all due to the Customer (for example the Customer has provided incorrect contact information, the Customer has changed their contact information or the recipient of the gift or the Customer is not present at the agreed delivery time can’t be reached)
- Product inspection, complaints and liability for defects
Upon receipt of the delivery, the Customer must immediately check that the delivered products are intact and otherwise flawless. The Customer must also ensure that the delivery includes all products ordered by the Customer.
If the Customer discovers that the delivery or product is defective, the Customer is requested to report any product defects and shipping damage to our customer service within seven (7) days of receiving the delivery. It is a good idea to check the delivery in the presence of a representative of the transport. If the delivered product has been damaged during transport, the Customer must ask the representative of the transport company to make a damage report, meaning an entry in the consignment note with the signatures. In addition, the Customer must contact Arkkikaluste’s customer service.
If the product is damaged during transport, photographs must be taken of both the packaging and the product. Pictures and additional information should be sent to our customer service at info@arkkikaluste.com as soon as possible. Damaged transport packaging must be kept until the complaint has been processed.
If there is a confirmation that there is a defect in the delivery or the product, Arkkikaluste has the primary right to correct the error or deliver a defect-free product within a reasonable time. Arkkikaluste is responsible for product defects in accordance with current consumer protection legislation.
- Warranty
If the product is covered by the Arkkikaluste warranty, this will be stated in the product information. The warranty does not limit the seller’s liability for errors under the Consumer Protection Act. The shipping list that came with your order serves as a warranty certificate. The warranty applies the warranty terms found in our Online Store, which may include restrictions.
Arkkikaluste is released from liability during the warranty period if it shows that the defect or breakage of the product has been caused by an accident, improper handling of the product or any other factor for which the Customer is responsible. If the error in the product is caused by the above-mentioned fact or the reported error is not detected in the product at all, Arkkikaluste has the right to charge the Customer a service inspection fee related to the warranty claim.
- Indemnity
Arkkikaluste is obliged to compensate for immediate damage only if the defect or damage is due to negligence on the side of Arkkikaluste or if the product at the time of sale deviates from what Arkkikaluste has specifically undertaken under a separate Warranty.
If the Customer cancels the order of the product after the statutory cancellation period of 14 days, Arkkikaluste is entitled to compensation for the special costs incurred to Arkkikaluste in concluding and performing the contract and which are likely to be useless, as well as special costs due to cancellation or cancellation.
For other damage, Arkkikaluste has the right to receive compensation that is reasonable, taking into account the price of the product, the time of termination or cancellation of the contract, the measures taken to fulfill the contract and other factors.
However, Arkkikaluste is not entitled to the compensation mentioned above if the cancellation of the Customer’s order is due to a provision of law, interruption of public or payment traffic or any other similar obstacle which the Customer cannot reasonably avoid or overcome.
- Right of withdrawal
The Customer has the right to cancel the product purchased from the Online Store within fourteen (14) days of receiving the product. Notification of cancellation can be made by univocal notification to info@arkkikaluste.com.
The customer must return the canceled product to Arkkikaluste within 14 days of sending the collection notice, in its original packaging.
The return address for the products is Tarjusojantie 15, 90440 Kempele.
However, the customer has no right of withdrawal for products that are manufactured or modified according to the customer’s requirements or clearly meet personal needs (custom-made products).
The customer is responsible for the cost of returning canceled products. Products must be unused and packed in the original packaging. Arkkikaluste will refund the value of the canceled products to the Customer using the payment method by which the Customer has paid for the product, if the Customer does not explicitly accept the return by another payment method.
Arkkikaluste will return the received payments without delay and no later than within 30 days of receiving the Customer’s cancellation notice. Arkkikaluste has the right to refrain from refunding payments until Arkkikaluste has received the product back. There is no cost to the customer for refunding payments.
If the Customer cancels the product, the Customer will be refunded the price paid by the Customer for the product, even if the price of the product has changed later.
Upon receipt of the product, the Customer shall keep it substantially unchanged and indelible until they have decided to keep the goods. If the returned product has been used in violation of the buyer’s duty of care under the Consumer Protection Act or the packaging has been opened in such a way that the product can no longer be resold, Arkkikaluste has the right to charge a discount up to the full price of the product.
- Overwhelming barrier
Arkkikaluste is not responsible for any delay in delivery, product defect or other breach of contract due to a circumstance beyond the control of Arkkikaluste. Even in such a situation, Arkkikaluste strives to serve the Customer in the best possible way.
- Processing of personal data and cookies
Arkkikaluste processes the personal data of Customers and gift recipients in the manner permitted and required by the personal data legislation in force at the time.
- Changing the Terms
Arkkikaluste reserves the right to change these terms and conditions at its sole discretion. Changes to the Terms will be effective upon notice. The Customer’s transactions in the Online Store after the change of the Terms and Conditions are confirmed by the Customer’s acceptance of the changes made to the Terms and Conditions.
- Applicable Law and Dispute Resolution
These Terms are governed by the laws of Finland, excluding its conflict of law provisions.
If the dispute concerning the contract cannot be resolved through negotiations between the parties, the consumer may refer the matter to the Consumer Disputes Board (www.kuluttajariita.fi). Disputes can also be resolved in the Oulu District Court in Finland. However, the consumer customer may take the dispute to the ordinary lower court of their domicile.
